This appeal from the action of the trial court in sustaining the third-party plaintiffs’ (hereinafter referred to as the Es-teses) motion for summary judgment emanates from the following fact situation. The Esteses had been sued by the plaintiff, Moore-Harris Abstract Company (hereinafter referred to as “the abstract company”), the assignee of warranties in a warranty deed from the Esteses to Carroll L.
