Action for damages for false imprisonment ($10,000.00 actual and $40,000.00 punitive) against the sheriff of St. Louis County, who was out of office when the case was tried. There was a directed verdict denying plaintiff’s claim against a third party for maliciously instigating the arrest and judgment for the third party became final on overruling plaintiff’s motion for new trial as to him, with no appeal from this judgment.
