This is an action for tbe wrongful death of plaintiff’s intestate, Lacy Shepherd. _ Upon the admissions in the answer and the nncontradicted testimony it appears that Lacy Shepherd died on the morning of 20 February, 1911, from injuries sustained by him the night before on the track of the defendant at Elon College. He lived south of the railroad and about a quarter of a mile west of the station.
