Reversing.
An indictment returned by tbe grand jury of Greenup county accused tbe appellant, Dewey Victor, of tbe crime of rape committed upon tbe body of Lizzie England Carr, a female about 24 yeans of age. Tbe husband of tbe prosecutrix, Butler Carr, was accused in tbe same indictment of aiding and abetting Victor in tbe commission of tbe crime. Tbe latter on bis separate trial was convicted and punished by confinement in the penitentiary for a period of 10 years. His motion for a new trial was overruled and be prosecutes this appeal.
