MEMORANDUM AND ORDER

NICKERSON, District Judge.

In this case, respondents Dennis Yacco and George Quinlan seek cover under the Eleventh Amendment for overseeing the appropriation of $2.5 million in proceeds from a corporation involved in labor racketeering activities with the Luchese organized crime family. Acting outside normal statutory channels and without judicial oversight or formal public notice, Vacco and Quinlan oversaw the distribution of the forfeiture proceeds to some victims of the crime while denying any share to other victims.
