Petitioner appeals a decision of the Secretary of the United States Department of Agriculture (“Secretary”) finding that he violated section 5(2)(B) of the Horse Protection Act (“Act”) as amended, 15 U.S.C. § 1824(2)(B). Petitioner argues that the evidence against him is insufficient to support the Secretary’s decision and, alternatively, that, even if he did violate the Act, the civil sanctions he was assessed nevertheless should be set aside. For the following reasons, we affirm.
