The plaintiff brought this action to recover of Dickinson three thousand and ninety dollars, with interest, etc. He alleges in his complaint that in the year 1860, and up to Jan*124uary 18th, 1861, he and the defendant were partners in San Francisco, doing business under the firm name of McKenzie & Co.; that about the last named day the partnership was dissolved, and that before the month of November next following all of the' interest of the defendant in the property which had belonged to the partnership was sold by the Sheriff under an execution against the property of…
