MEMORANDUM AND ORDER

MacLAUGHLIN, District Judge.

This matter is before the Court on defendant’s motion to dismiss for lack of sub ject matter jurisdiction or in the alternative for summary judgment. Defendant’s motion for summary judgment will be granted.

FACTS

Plaintiff Corrinne Smith and her husband plaintiff Robert Earl Smith are residents of Minneapolis, Minnesota. Plaintiff Group Health Inc. is a corporation also located in Minneapolis.
