This appeal is from a judgment of conviction rendered in the district court of Pottawatomie county on October 17, 1938, and sentence in pursuance of the verdict of the jury, finding “the defendant guilty of assault with a dangerous weapon as charged in the information and assess his punishment at three years in the state penitentiary.”
