Certiorari to Shiawassee; Smith, J. Habeas corpus proceedings by William Devereaux, special guardian of Lyman H. Janes, against Charles A. Janes and Emma Janes to obtain the custody of his ward. There was an order dismissing the writ, and petitioner brings certiorari.

This is certiorari to review the decision of the circuit judge dismissing a writ of habeas corpus, sued out by the petitioner and plaintiff in error to obtain custody of Lyman H. Janes, who is alleged to be the petitioner’s ward. The petition sets out the proceedings before the probate court in part, from which it appears that a petition for the appointment of a special guardian was made on December 14, 1904, and that the same day an order appointing a special guardian was entered in the following terms:
