ORDER GRANTING DEFENDANT’S MOTION TO DISMISS
WELLFORD, District Judge.
Plaintiff Henry Hawkins, Jr. filed a charge of discriminatory terms and conditions of employment against defendant International Harvester with the Equal Employment Opportunity Commission. Upon investigation, the EEOC declined to pursue the charge to litigation, but granted plaintiff’s request for a right to sue under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq.
