Appeal by the defendant, Louis Becker, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Erie on the 21st day of December, 1915, upon the verdict of a jury, and also from an order entered in said clerk’s office on the same day, denying defendant’s motion for a new trial made upon the minutes.

The plaintiff has recovered a judgment upon the verdict of a jury for commissions on the sale of real estate negotiated by him for the defendant.
The peculiarity of the caséis that the real estate, the subject of the sale, belonged to the Jefferson Exhibition Company, a corporation of which the defendant was the president, although the complaint alleges that the defendant was the owner of the real estate.
