Defendant appeals a judgment of conviction for possession of a burglary tool or theft device, ORS 164.235, raising two assignments of error. He contends in one assignment that the trial court erred in denying his motion under Article I, section 9, of the Oregon Constitution that sought to suppress evidence found as a result of a search of a bag. He contends in his other assignment that the court erred in denying his motion under Article I, section 12, of the Oregon Constitution that sought to suppress statements that he made in response to police questioning.
