In this action to recover damages for fraud, defendants Manny E. Duell (Duell) and 1045 Fifth *1048Avenue Corp. (Fifth Ave.) settled with plaintiffs for the sum of $250,000, pursuant to a stipulation of settlement and discontinuance among them entered into just before the case was submitted to the jury. The jury returned a verdict of $1,000,-000 against defendants First National City Bank (Citibank), Lexman Realty Corp., (Lexman) and Julien J. Studley, ínc. (Studley).
