THIS CAUSE is before the Court upon the defendants Motiva Enterprises, LLC (“MOTIVA”) and Shell Oil Company (“SHELL”)’s motion to dismiss the plaintiffs Second Amended Complaint or in the alternative for summary judgment [DE# 73] 1 in a case brought under the Petroleum Marketing Practices Act, 15 U.S.C. § 2801 et seq.
