Appellant herein was prosecuted in the Superior Court, Ponce Part, for a violation of § 4 of the Bolita Act, No. 220 of May 15, 1948 (Sess. Laws, p. 738) ; 33 L.P.R.A. § 1250.1 It was alleged that “on or about April 17, 1954 . . . unlaw*699fully, voluntarily, maliciously, and criminally he had in his possession and control, tickets which may be used and were used in the unlawful bolita or bolipool game.” After a trial, he was convicted and sentenced to a term of 9 months in jail.
