Before Thomson, J., Richland, April, 1879. These were two actions heard together. The first, Jesse E. Dent against Sarah H. Bryce, was an action to recover a lot of land in the city of Columbia; the second, The Mechanics’ and Farmer’s’ Building and Loan Association, of Richland, against the same defendant, was an action to recover the Bluff plantation, six miles below Columbia, in Richland county.

These two cases were heard together on appeal, and as they involve' the same questions, but one opinion will be pronounced.
*8The questions involved, arise, upon exceptions to the rulings of the Circuit judge upon the testimony offered at the trial and upon the refusal of the Circuit judge to grant a new trial, the defendant being the appellant in both cases.
