Plaintiff Ms. Marion Kindig (“Plaintiff’ or “Ms. Kindig”) sued Defendant Whole Foods Market Group, Inc. (“Defendant” or “Whole Foods”) for personal injuries arising out of an alleged slip and fall incident in the parking lot of a Whole Foods store. Defendant Whole Foods filed a Second Motion for Summary Judgment (“Def.’s Mot.”) [114].
