THOMAS, Circuit Judge.
This is an appeal from a judgment against appellants for damages for person al injuries sustained by appellee, plaintiff below, as a result of being run over by appellants’ locomotive.
Tlie plaintiff in his petition, as amended, alleged that the injuries for which he demanded damages were the direct and proximate result of the negligence of the defendants and their agents, the engineer and fireman in charge of the locomotive.
