OPINION OF THE COURT
VAN DUSEN, Senior Circuit Judge.
Petitioner J. I. Hass Co., Inc. (“Hass”) seeks review of an Occupational Safety and Health Review Commission (“Commission”) order.1 This order determined that because Hass had not filed a timely notice of contest, the Commission could not review the citations and penalties imposed on Hass pursuant to the Occupational Safety and Health Act of 19702 (“Act”). We disagree. The Commission’s order will be set aside and the case remanded to the Commission for proceedings consistent with this opinion.
