This is an action brought under § 205 (g) of the Social Security Act, 42 U.S. C.A. § 405(g) to review a “final decision” of the Secretary of Health, Education and Welfare. The defendant has moved for summary judgment.

The facts in the case are relatively clear and are generally agreed upon by both parties. Mrs. Ada Holthoff, plaintiff, filed an application for old age benefits under the Social Security Act on March 5, 1957.
