delivered the opinion of the court.

An action on the case was instituted by plaintiff against defendant in the circuit court of Winnebago county to recover damages for the alleged failure of defendant to use reasonable care and skill in the defense of plaintiff under an indictment for murder.

A demurrer was sustained to the original declaration. Thereafter the plaintiff filed an amended declaration, consisting of two counts, to which the defendant filed a demurrer, general and special. The demurrer was sustained, and, the plaintiff electing to abide his declaration,…
