Petitioners Asim Chaudhry, his wife Neelofer Asim, and their two minor children—all citizens of Pakistan—came to the United States in 2003 as nonimmigrant visitors. Three years later, Chaudhry filed an application to adjust his status to “lawful permanent resident.” The United States Citizenship and Immigration Services (CIS) rejected Chaudhry’s application because, by statute, applicants who have accrued more than 180 days without “lawful status” lose their eligibility for adjustment of status.
