MEMORANDUM DECISION

CHIN, District Judge.

Plaintiff Gerald D. Broder, a New York City resident, maintains a summer house in Bridgehampton, New York, where he subscribes to cable television services from defendant Cablevision Systems Corporation (“Cablevision”). Although he uses his Bridgehampton house primarily in the summer, since 1997, with the exception of one year, he has paid full rates for the cable services year-round.
