Numerous motions are currently pending before the court in this matter. First, Gulf Resources & Chemical Corporation (Gulf) and Pintlar Corporation have filed with the court a Motion for Relief from Order. In count three of the amended third-party complaint, Gulf and Pintlar alleged the tort of bad faith against various insurers. In this court’s decision filed September 2, 1986, 647 F.Supp. 1064, in attempting to construe Idaho law, the court held that the State of Idaho did not recognize an independent tort for bad faith separate and distinct from contractual…
