1. A brief reference to the testimony is necessary to an understanding of the questions to be determined on this appeal. The only witnesses whose evidence is material were the plaintiff and the witnesses Hartwig and Trumbull. Plaintiff' testified that he had worked at the mill four or five days before his accident; that he was employed to run the cut-off saw, but it had not been put in; that in the meantime he was directed to operate the lumber car, help roll logs to the mill, and help generally about the mill by doing anything “he saw to be done”; that the…
