MEMORANDUM AND ORDER
VAN BEBBER, Chief Judge.
Plaintiff brings this action seeking damages from defendants’ unlawful sales of natural gas within plaintiff’s certificated service area. The case is before the court on plaintiffs motion for partial summary judgment (Doc. 43) and defendants’ motion for summary judgment (Doc. 47), both of which raise a variety of issues. For the reasons set forth below, the court finds that: (1) plaintiff may maintain a cause of action under K.S.A. 66-176; (2) genuine issues of material fact remain with respect to the causation and amount of plaintiffs damages; (8)…
