Plaintiff, Elizabeth V. Roberts, and one William A. Roberts were husband and wife. On August 21, 1917, they purchased certain described land in Monterey County, the deed being taken in the name of William A. Roberts alone. The property was paid for out of community funds, substantially all of which had been accumulated before July 26, 1917, on which date section 172a of the Civil Code (Stats. 1917, p. 829), hereinafter considered, became effective.
