I. INTRODUCTION

Before the Court is the second round of cross-motions for summary judgment in this Freedom of Information Act (“FOIA”) dispute between the American Civil Liberties Union (“ACLU”) and the United States Department of Justice (“DOJ”) that began with a March 29, 2013 request for records from DOJ pertaining to DOJ’s policy on giving notice to criminal defendants and others against whom it intends to use evidence derived from warrantless surveillance.
