This is a proceeding on a writ of habeas corpus. The relator was convicted by confession of the crime of carrying a pistol as a misdemeanor, and was sentenced to the New York City Penitentiary on July 14, 1933, by a judge of the Court of General Sessions. The sentence was that he be imprisoned in the penitentiary, there to be dealt with according to law. The parole commission of the city of New York purported to fix his sentence, in a manner hereinafter set forth, at a period of fifteen months.
