This matter is before the Court on the “Motion for Summary Judgment” [Doc. No. 20] filed by defendant FCC Finance, LLC (“FCC”). The Court received the response in opposition from plaintiff Joann Hoehn [Doc. No. 24] and defendant’s reply [Doc. No. 25]. The Court exercises its discretion to decide defendant’s motion without oral argument. See Fed.R.Civ.P. 78; L. Civ. R. 78.1.
