PRICE, Chief Justice.

This is an appeal from the judgment of the 41st District Court, El Paso County, Texas, wherein Elton R. Gish was plaintiff and A. J. Blaugrund, defendant. Plaintiff sought to recover damages alleged to have been caused in a collision between an automobile driven by plaintiff and a truck driven by defendant’s employee. The basis of the cause of action alleged was negligence on the part of the driver of defendant’s truck. The trial was before the court with a jury, the submission on special issues.
