The case before us involves a claim of entitlement to asylum by petitioner Tian-Yong Chen, who alleges that he suffered persecution by the People’s Republic of China on the. basis of his Roman Catholic faith and that he would suffer renewed religious persecution if he were returned to China. In a June 15, 2000 decision, the Board of Immigration Appeals (“BIA”) dismissed Chen’s appeal from the order of an immigration judge (“IJ”), which denied Chen’s application for asylum and for withholding of removal and ordered him deported from the United States if he…
