MEMORANDUM AND ORDER
MAUSKOPF, District Judge.
RLI Insurance Company (“RLI”), an Illinois corporation, commenced this action in October 2006, and currently asserts claims against Athan Contracting Corp. (“Athan”), a New York corporation; Atha-nasios Koukoulis (“Koukoulis”); Demetri ous Rexines (“Rexines”); and Harvey Pincus, in his capacity as Executor of the Estate of Maxine Pincus (“Pincus”). Before the Court are two motions for summary judgment, one filed by RLI and the other by Pincus, pursuant to Federal Rule of Civil Procedure 56. For the reasons set forth below, both motions are GRANTED.
