Julius Oppenheimer filed a bill of complaint in the circuit court of Cook county alleging that on February 19, 1908, Mary Szulerecki demised and leased to him certain premises in the city of Chicago from May 1, 1908, to April 30, 1918, for the sum of $12,000, payable in monthly installments of $100 each, in advance; that the lease contained a clause by which it was agreed that in the event that the demised building, or any part thereof, should be rendered untenantable by fire or other casualty the lessor - should restore the same within ninety days after such loss, damage or destruction, and…
