Mrs. Mollie T. Ballew lived alone just outside the corporate limits of Magnolia. She was found dead on March 21, 1956, apparently having expired of a heart attack about two days earlier. She died intestate and *185left surviving as her sole and only heirs at law the appellant James E. Ballew, a resident citizen of McComb, Mississippi, Ellis Ballew, a resident citizen of Kevil, Kentucky, Mrs. Mildred B. Case, a resident of Magnolia, and Mrs. Mary B.
