COLLARD, Judge, Section A.

We will first dispose of the motion by Collins, defendant in error, filed in the Commission of Appeals at Austin, April 15, 1891.

Bicker, Lee & Co. were contractors to build for the Gulf, Colorado & Santa Fe Railway Company a part of its road, and Collins was a subcontractor to make for them certain excavations. There was a dispute after the work was done about the classification of a part of it, Collins claiming that it was solid rock, and Bicker, Lee & Co. claiming that it was loose rock.
