In this action plaintiff seeks to recover damages for malicious prosecution as a result of his having been committed *409to the state hospital as insane. At the conclusion of plaintiff’s case in chief, the defendants each moved for a directed verdict. The trial court sustained the motions. Plaintiff filed a motion for a new trial which was overruled. He ap-' peals to this court assigning as error the directing of the verdict and the overruling of the motion for a new trial.
