This is an appeal from a conviction had in the district court of Seminole County, wherein the plaintiff in error, hereinafter referred to as defendant, was charged with the crime of burglary in the second degree, and subsequently sentenced to serve three years in the State penitentiary.

The information, filed in said court on September 25, 1959 charged this defendant, along with Joe Cortez and Donald' Holmes Northcott, with breaking and entering the Chaney Drug, in the city of Wewoka, on July 14, 1959 and taking from' said building certain personal property, consisting of one steel safe…
