MEMORANDUM OPINION AND ORDER

I. INTRODUCTION

In this lawsuit, Plaintiff Darrell Hinson (“Plaintiff’), an African-American male, alleges that Defendant Chelsea Industries, Inc., (“Defendant”) terminated his employment based upon his race. Plaintiff brings his claims pursuant to Title VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 2000e-2000e-17 (“Title VII”), and 42 U.S.C. § 1981 (“ § 1981”).
