Mr. Chief Justice Moschzisker,. Charles F. Mellor was found “guilty of murder of the first degree, with the penalty of death,” and sentenced accordingly; he has appealed. .

On March 23, 1928, about ten o’clock in the evening, one Harrison, the manager of the Cross Keys Theater, Philadelphia, left that establishment carrying a satchel containing the cash receipts of the day; he was accompanied by a policeman named Clark, who acted as his bodyguard.
