This is an action by plaintiff, appellant, against the defendant, appellee, for damages for the alienation of the affections of plaintiff’s wife and their alleged criminal conversation. The averments of the petition are stated in plaintiff’s brief, and are here produced as there stated: “(1) That Mattie May Wheeler'is the lawful wife of the plaintiff, and has been such ever since the 16th day of February, A.
