EMILIO M. GARZA, Circuit Judge:

Defendant Donald L. Beckner appeals his conviction for four counts of wire fraud, in violation of 18 U.S.C. § 1343, and one count of perjury, in violation of 18 U.S.C. § 1623. We reverse and remand.

Beckner was a prominent Baton Rouge attorney and a former United States Attorney for the Middle District of Louisiana. Sam Recile, a New Orleans real estate developer, retained Beckner to defend an injunc-tive action brought against Recile by the Securities and Exchange Commission.
