DOBIE, Circuit Judge.. .Hemphill Company (hereinafter called Hemphill)..filed, in the United States District Court for the.Middle District of North Carolina, a civil action .against Benjamin, H. Jordan, doing business as Jordan Manufacturing Company, alleging infringement by Jordan of'two patents owned by Hemp-hill.' The District Court found for Hemp-hill on all the vital issues, held that the patents in suit were valid and infringed by Jordan, enjoined Jordan from further infringement, and .referred the case to a Master to assess damages.
