Courtney 'Combs and bis brother, I. M. Combs, were partners operating under the firm name of Combs Bros. On October 17, 1921, they, as such partners, purchased from E. D. Vanhoose a hotel building, the lot upon which it stood, and its furnishings, all located in Paintsville, Ky., for the consideration of $40,000, some of which was paid at the time, some of which was prior lien indebted*676ness assumed by them, and tbe balance of something like $25,000 was evidenced-by the note of vendees executed to Vanhoose, wherein…
