Reversing.

The appellant, S. J. Pancake, was indicted by the grand jury of Greenup county, charged with the offense of false swearing, which is one denounced by section 1174 of our present Statutes. At his trial thereunder he was convicted and punished by confinement for one year in the penitentiary.
