This is virtually an application for a writ of mandate. The complaint alleges that the plaintiff is the lawful commissioner of arid lands of the state of Washington; that he was duly appointed and commissioned as such for the term of four years commencing on the 16th *628day of June, 1895, and ending on the 16th day of June, 1899, and duly qualified and entered into possession of said office on the said 16th day of June, 1895, and has been in possession of said office and has discharged the duties thereof from that time to the present, and is at…
