This is an appeal from the trial court's order, by way of summary judgment, denying a petition for issuance of writs of quo warranto and mandamus.

In January 1987, after his election to a first term as Governor of Alabama, Guy Hunt submitted to the senate the appointment of Zack Thompson as state banking superintendent. The appointment was made pursuant to § 5-2A-3, Code 1975. That Code section provides, in part, as follows:

"The state banking department shall be in the charge of the superintendent, who shall be the chief executive officer of the department. . . . The superintendent shall be…
