Judgment, Supreme Court, Bronx County (Nicholas Figueroa, J.), rendered October 20, 1988, convicting defendant, after a bench trial, of criminal mischief in the third degree and sentencing him, as a predicate felony offender, to an indeterminate term of imprison-*833merit of 2 to 4 years, unanimously modified, on the law and as a matter of discretion in the interest of justice, to the extent of reducing the conviction to one for criminal mischief in the fourth degree, vacating the sentence and resentencing defendant to time served, and except as so modified, affirmed.
