OPINION
BUSSEY, Presiding Judge:
The appellant, Danny Lynn Farris, was convicted in Oklahoma County District Court, Case No. 80-2248, of Manslaughter in the First Degree and was sentenced to thirty-five (35) years imprisonment. On ap peal the appellant assigns six points of error.
Briefly stated the facts of the case are that Reginald Zabawa was shot and killed in the early morning of June 3, 1980, shortly after returning to the appellant’s home from a party.
